It is a well recognised fact that employers make more mistakes when dismissing an employee than at any other time during the employment relationship. It is not surprising therefore that unfair dismissal allegations account for the single largest number of claims before the courts.
Employers are strongly advised to follow a documented procedure when considering dismissing an employee, one which complies with the ACAS Code of Practice on Discipline and Grievance – although this Code does not apply to dismissals by reason of redundancy or the expiry and non renewal of a fixed term contract.
