Head of the Personal Injury & Insurance Department

James Millar Craig heads our Personal Injury and Insurance Department and has over 34 years litigation experience.  He has been a partner since 1983.  He can recall working through the last 2 recessions in the 1970s and early 1990s – unlike many other colleagues!

Expertise and clients
During his career, James has dealt with a wide spectrum of general litigation work, together with a speciality in Personal Injury, Clinical Negligence and Insurance claims.  The majority has been in the High Court.  Also, throughout that period, he and the firm have acted for Christie Group Plc and their subsidiaries, including Christie + Co., a leading commercial business agent.  James has continued to act for Directors personally.

Permanent Health Insurance (PHI) and other insurance litigation
James has over 20 years experience of this specialist area.  The claims have involved a variety of illnesses, including specifically ME/CFS disputes.  James is recognised as an expert in this field by ME Association, Action for ME, Fibromyalgia Association and Unum Claimants Support Group.  James has written extensively on the subject and appeared on television, radio and in Parliament.  Over the years claims have succeeded against Unum, Resolution, Liverpool Victoria, Friends Provident, Aviva, Canada Life, Zurich, Wesleyan, Abbey Life and many other insurers.  Other claims have related to Critical Illness policies and insurance law generally.

Personal Injury claims
The work carried out by James and his team includes major RTA claims, Fatal Accident Claims, Uninsured or Untraced MIB claims, Industrial Disease, specifically Asbestos related illness claims and other Accidents at Work.

Clinical Negligence
James has dealt with complex Clinical Negligence claims for many years and this continues to be an expanding area of work.  Often they relate to failed operations or treatment at hospitals leading to major causation disputes and damages enquiries.
