Our insolvency team is a cross-departmental group consisting of partners and lawyers from the company commercial, property, employment and litigation teams. We provide the expertise required to help both corporate and individual clients facing an insolvency situation. Our experience means that we fully understand the issues involved in both corporate and personal insolvency, restructuring and turnaround and can take a practical and commercial approach to protecting the interests of our client.
We advise on the correct decision to make where an insolvency situation is unavoidable and explain the different processes involved. In addition, our contacts within the industry mean we can connect you to the right third party and be involved in integrated decisions.
We advise on all aspects of distressed M & A, rescues and restructurings and have acted for corporates, shareholders, directors, banks and insolvency practitioners. It is this breadth of experience and ability to ‘see both sides of the story’ that provides us with the experience to deal quickly and commercially with any issue which arises, who ever we are acting for.
The nature of insolvency means that director duties, personal liability and director disqualification issues are key areas we advise on, as well as issues relating to restructuring and insolvency litigation, including:
· Trustee recovery of preferred and fraudulent conveyances;
· Pursuit of claims;
· Director and officer liability defence;
· Inter-creditor disputes and subordination; and
· Judgment enforcement; and creditor claim recovery.
We are able to draw effectively on the expertise of our other teams including banking and debt recovery and, where necessary, utilise the Interleges Network where multi jurisdictional issues arise.
